Bringing a claim against your professional advisors

In today’s society we place increasing reliance on professional advisers in order to protect our businesses and facilitate transactions. Unfortunately we are sometimes let down by our professional advisers. Whether it be a claim against your former Solicitors, architects, surveyors, accountants or other professional we can hold them accountable for the loss that you have suffered.

We can advise you pre-action in accordance with the Court’s Pre-Action Protocol for Professional Negligence. It is often possible to recover compensation without having to issue formal Court proceedings. The Court’s encourage alternative dispute resolution through which assists parties in resolving disputes on an informal but structured basis.

Defending professional advisors

We act for professional advisors, often through their insurers, in defending claims brought against them by clients.

It is important to tackle claims and potential claims head on in compliance with the Pre-Action Protocol for Professional Negligence. If claims are effectively managed pre-action then it is often possible to resolve matters without unnecessary costs being incurred.

The Courts are increasingly encouraging parties to consider forms of Alternative Dispute Resolution (ADR) such as mediation, arbitration and expert evaluation/determination. We are experienced in ADR and wherever possible recommend its use. We have successfully settled disputes for clients through mediation and other forms of ADR.

If the claim does become the subject of litigation then we provide a full case plan advising on both quantum and liability. Where settlement is advisable we will ensure than any settlement is based on an accurate assessment of the Claimant’s loss and prospects of success.
