Dismissal Claims

If your employer does not have a fair reason for your dismissal or has not followed statutory disciplinary procedures then you may have a claim for unfair dismissal. If you are unfairly dismissed then an Employment Tribunal may make an award of damages. An Employment Tribunal award usually includes the basic award based on your age and your length of service as well as a compensatory award of up to £56,800 for losses such as loss of earnings.

Wrongful dismissal claims arise out of a breach of your employment contract by your employer. They usually arise where an employee has been dismissed without proper contractual notice.

If you believe that your relationship with your employer has broken down to such an extent that you cannot continue working for them, then it may be possible to leave your job and bring a claim for constructive dismissal which may include a claim for unfair dismissal and/or wrongful dismissal. It is important to get advice early as working your notice period, for example, may prejudice your claim.
