Family and MatrimonialInheritance disputesEnglish law, unlike many European legal systems, recognises the principles of freedom of testamentary disposition. If, however, equitable provision is not made for certain classes of dependants then a claim may be made against the estate under the Inheritance (Provision for Family and Dependants) Act 1975. We advise both clients who are pursing a claim and those that are resisting claims brought on behalf of a class of beneficiary. As we see things from both sides we have a unique perspective that enables us to advice from both standpoints.
